Legislative Advocacy this Week at the State Capitol

HB 1006 is supported by the Legislative Policy Committee (LPC) because it will help property owners that lease have the ability to get a property tax exemption for childcare. We think that this is a good public policy change that will help increase daycare and childcare centers in commercial buildings that might be repurposed post-pandemic and provide better access to affordable quality of life choices for property owners.

Under the state constitution, property used solely and exclusively for charitable purposes is exempt from property tax, unless otherwise provided by law. Under this constitutional authority, there is currently a statutory exemption for property used as an integral part of a childcare center. This bill modifies that exemption by repealing the requirement that the property must be owned for strictly charitable purposes and not for private gain or corporate profit, and that the property must be irrevocably dedicated to a charitable purpose. These changes allow property leased or rented by a tenant to operate a childcare center to be eligible for the property tax exemption.

HB 1030 is being monitored by the LPC. The bill creates a refundable income tax credit for tax years 2022, 2023, and 2024 for eligible individuals or package delivery companies. The credit can be claimed in an amount equal to the claimant’s cost for purchasing a  “package anti-theft device” during the tax year, up to $75. The credit may be claimed by an individual who has filed a police report for a stolen package and subsequently purchases a package anti-theft device or by a package delivery company who donates a package anti-theft device to such a person.

SB 030 is being monitored by the LPC. The bill expands the scope of the Water Resources Review Committee to include identifying, monitoring, and addressing agricultural issues, and renames it the Water Resources and Agriculture Review Committee.
