3 Things to Know

 

Wildfire Resiliency Code Deadline Approaching. Implementation of “Establishment Of A Wildfire Resiliency Code Board” (Senate Bill 23-166) continues to move forward, with a key milestone approaching this year. This 2023 law created the Wildfire Resiliency Code Board, which is responsible for adopting statewide model codes — such as hardening structures and improving defensible space around buildings — in order to reduce wildfire risk in Colorado’s wildland-urban interface (WUI). The board was required to adopt its initial statewide policy by July 1, 2025, and local governments within the WUI must thereafter adopt or enforce standards that meet or exceed those standards. Local governments were given until April 1, 2026, to adopt this code, and until July 1, 2026, to be in full compliance with it. While these standards may impact building practices, they will strengthen long-term stability in the WUI — which is an important factor insurers will consider when determining coverage availability and risk. Support for Expanding Homeowner Resources for Property Mitigation. “Homeowner Natural Disaster Mitigation” (Senate Bill 49) was introduced in late January, with a goal of expanding the uses of Colorado’s existing Natural Disaster Mitigation Enterprise. The bill allows HOAs and individual property owners to apply for grants funded by the enterprise to support projects such as slope stabilization, fuel reduction, installation of impact-resistant roofing, and other property-specific mitigation efforts that strengthen resiliency. It also establishes a Catastrophe Savings Account that allows individuals to set aside funds for mitigation efforts. This would mean that between 2027 and 2036, homeowners could deduct up to $50,000 deposited in these accounts from their taxable income. CAR supports this bill, recognizing the importance of expanding access to resources that help homeowners take on these efforts—knowing that these are steps that can improve the insurability of homes in higher-risk areas. The bill has not yet been scheduled for a hearing, and CAR will continue to keep members informed as it progresses through the legislature.

 

Keeping Homes Clear of Rodents. CAR successfully opposed the most problematic provisions in Rodenticide Use Restrictions” (Senate Bill 62) to protect homeowners’ ability to keep properties pest-free. As introduced, the bill proposed sweeping restrictions that would have banned non-anticoagulant and both first-and second-generation anticoagulant rodenticides, limited rodenticide use to licensed applicators, restricted common tools such as glue traps, and imposed pest management requirements—effectively eliminating many products homeowners and landlords rely on to maintain rodent-free environments. CAR raised concerns about the bill’s impact on the warranty of habitability for multi-family housing when relying on 3rd-party vendors for rodent remediation, as well as the potential for delays in real estate transactions caused by such remediation. Following this advocacy, the bill was significantly narrowed and now applies only to second-generation anticoagulant rodenticides, which are not available for retail and have been highly regulated by the U.S. Environmental Protection Agency since 2014.

New Hearing Date for Landlord/Tenant Evictions Bill. “Evictions Protections for Tenants” (House Bill 1106) proposes sweeping changes to Colorado’s eviction process — including daily caps on evictions hearings, broadly defined grounds that require courts to delay proceedings, the elimination of the appeals bond, and restrictions on executing writs during defined “inclement weather” — has been rescheduled to Tuesday, March 24th. CAR remains concerned about the bill’s negative impact on housing providers and their operations. Increasing Housing Without Additional Costs to Taxpayers. CAR strongly supports Workforce Housing and Housing Tax Credit” (Senate Bill 1), a bill that gives county governments the flexibility they need to support local housing authority efforts. The bill is simple: it authorizes the use of property tax revenue in the general fund to help its local housing authority, sell real property for affordable housing development, and broadens the ownership of the middle-income housing tax credit. It stands in stark contrast to the slew of legislation that would increase taxes in a time when the statewide median sales price is $535,000. It passed without amendments or controversy on a vote of 12-0 in its House committee hearing and is well-positioned to pass through the House before reaching the Governor’s desk.
